These Terms of Use (“Terms”) govern your access to and use of the SwingFeel mobile application, website, and related services (collectively, the “Service”) operated by Game Improvement Apps, LLC (“Company,” “we,” “us,” or “our”).

By downloading, accessing, or using SwingFeel, you agree to be bound by these Terms. If you do not agree, do not use the Service.

SwingFeel is a mobile application that provides:

• Golf swing drills
• Golf-specific exercises
• Stretching routines
• Mobility training
• Instructional golf improvement content

The Service is intended for general educational and informational purposes only.

SwingFeel does not provide medical advice, physical therapy, or professional golf instruction.

You must be at least 18 years old to use the Service.

By using SwingFeel, you represent that:

• You are at least 18 years old
• You are physically able to participate in exercise activities
• You are responsible for determining whether the activities are appropriate for you

SwingFeel provides exercise and golf training content.

You acknowledge that:

• Physical activity involves inherent risks
• Improper exercise may cause injury
• Golf swings and drills may result in injury or property damage
• Results from training programs vary by individual

You should consult a physician or qualified healthcare provider before beginning any exercise program.

If you experience:

• Pain
• Dizziness
• Shortness of breath
• Injury
• Physical discomfort

You should stop immediately and seek medical attention.

Nothing within the Service should be interpreted as medical advice or diagnosis.

By using SwingFeel, you acknowledge and agree that participation in golf drills, stretching routines, and exercises carries inherent risks.

These risks include but are not limited to:

• Muscle strain
• Joint injury
• Sprains or tears
• Back injury
• Falls
• Equipment-related injuries
• Injury caused by golf club swings

Additionally, performing drills indoors may result in:

• Damage to walls
• Damage to furniture
• Broken objects
• Damage to golf equipment
• Injury to nearby individuals or pets

You voluntarily assume all risks associated with using the Service, whether known or unknown.

You are solely responsible for ensuring that you have a safe environment when performing exercises or golf drills.

You agree to ensure that:

• Adequate space is available before swinging a club
• No people or pets are nearby
• Fragile property is not within range of a golf swing
• Your equipment is in safe condition

Game Improvement Apps, LLC does not supervise your use of the Service and cannot ensure safe use.

To the fullest extent permitted by law, you hereby release, waive, and discharge Game Improvement Apps, LLC and its:

• members
• managers
• employees
• contractors
• affiliates
• partners
• licensors

from any and all claims, demands, damages, liabilities, costs, or expenses arising from:

• your use of the Service
• performing exercises or drills
• swinging a golf club
• following any instructional content within the app
• injuries sustained during physical activity
• damage to personal or real property

This release applies to all claims, including those arising from negligence, to the fullest extent permitted by law.

To the maximum extent permitted by law, Game Improvement Apps, LLC shall not be liable for:

• personal injury
• property damage
• loss of profits
• loss of data
• indirect damages
• incidental damages
• consequential damages

arising from the use of the Service.

If liability is found despite these Terms, the Company's total liability shall not exceed the greater of:

• $100, or
• the amount you paid to use the Service during the previous 12 months.

You agree to indemnify, defend, and hold harmless Game Improvement Apps, LLC and its members, officers, employees, contractors, and affiliates from any claims, damages, liabilities, losses, and expenses arising out of:

• your use of the Service
• your participation in exercises or drills
• injury to yourself or others
• damage to property caused while performing drills
• violation of these Terms

If you are a California resident, you waive California Civil Code §1542, which states:

“A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release.”

You acknowledge that you fully understand this waiver and voluntarily waive these protections.

You may need to create an account to access certain features.

You agree to:

• provide accurate information
• maintain the security of your account
• notify us of unauthorized use

You are responsible for activity occurring under your account.

Some features may require payment.

Subscriptions:

• are billed through Apple App Store or Google Play
• automatically renew unless canceled
• may be canceled through the relevant app store

We do not control billing policies of app store providers.

All content in SwingFeel is owned by Game Improvement Apps, LLC or its licensors, including:

• training programs
• exercises
• drills
• videos
• images
• logos
• software

You may not copy, distribute, reproduce, or commercially exploit any content without permission.

You agree not to:

• reverse engineer the Service
• attempt to hack or disrupt the app
• scrape data from the Service
• use the Service for unlawful purposes
• 
  

The Service may integrate with third-party services including:

• Apple App Store
• Google Play
• analytics providers

We are not responsible for the actions or policies of third-party services.

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, rather than in court.

Arbitration will be conducted under the rules of the American Arbitration Association.

Arbitration shall take place in Florida, unless otherwise required by law.

You agree that any dispute resolution will be conducted only on an individual basis.

You waive the right to participate in:

• class actions
• collective actions
• representative lawsuits

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.

We may suspend or terminate your access to the Service at any time for violation of these Terms.

We may update these Terms periodically.

The updated version will be posted within the Service with an updated Last Updated date.

Your continued use of the Service constitutes acceptance of the revised Terms.
